Terms of Service

Bula. These Terms of Service ("Terms") form the agreement between you and Talent Fiji Pte Limited ("Talent Fiji", "we", "us", "our") when you use the Talent Fiji platform at talentfiji.com or any associated mobile applications, services, or APIs (together, the "Service").
By creating an account or otherwise using the Service, you confirm that you have read these Terms, you agree to them, and you have the legal capacity to enter into this agreement.
1. Definitions
- Candidate — a natural person who creates a Service account to search for or apply to employment opportunities.
- Employer — a person or organisation that creates a Service account to post listings, receive applications, or recruit.
- Founding Cohort — the invitation-only group of the first 30 Employers, who receive the launch-period benefits set out in Section 10(g).
- User — any Candidate, Employer, or visitor to the Service.
- Listing — any job, role, or vacancy advertisement posted on the Service.
- Content — any text, image, file, message, profile data, CV, or other material uploaded, posted, or transmitted via the Service.
- Subscription — any recurring paid plan offered on the Service.
2. Eligibility
You must be at least 16 years old to create a Candidate account, at least 18 years old to create an Employer account, or the minimum working age in your jurisdiction — whichever is older. Age is self-attested at signup; we may request verification if we have reason to doubt eligibility.
You must have the legal capacity to enter into a binding contract. If you are creating an Employer account on behalf of an organisation, you warrant that you are authorised to bind that organisation to these Terms.
We may decline registration or suspend access to anyone we are prohibited from providing the Service to under applicable law, including Fijian or any other applicable sanctions, anti-money-laundering, or export-control regimes.
3. The Service we provide
Talent Fiji is a two-sided online jobs marketplace. We provide tools that allow Candidates to create profiles, search and apply for Listings, and message Employers; and tools that allow Employers to post Listings, receive and review applications, message Candidates, and manage their hiring workflow.
We are an intermediary platform. We do not employ Candidates. We do not act as a recruitment agency. We do not guarantee any hiring outcome. Any employment relationship is solely between the Candidate and the Employer, and is governed by the applicable employment law of the jurisdiction in which the role is performed — including, for Fijian roles, the Employment Relations Act 2007.
4. Binding commitments
These commitments are part of our contract with you. They are not marketing claims; we are bound to them and accept liability for breach.
(a) How AI is used on the Service
Search results and ordering on public-facing Service surfaces are deterministic — based on factors such as Listing tier, recency, and Employer-set filters. We do not use artificial intelligence or machine learning to rank, score, or filter Candidates in the public search experience.
We do offer Employers AI-assisted decision aids: a Job Description writer, a Job Description quality score, an Applicant Summary on Premium listings, and a daily Applicant Shortlist email on Premium listings. These outputs are suggestions only. Every interview decision and every hire decision is made by a human Employer. AI never auto-applies on a Candidate's behalf, never auto-rejects an applicant, never auto-publishes a Listing, and never sends a message on a User's behalf.
Inputs to our AI models are logged for audit and are subject to bias-mitigation processing — the model does not receive name, age, gender, ethnicity, photograph, or address when producing applicant summaries.
(b) No third-party advertising on the Service
We do not display third-party advertising of any kind on the Service. Revenue is derived solely from Employer payments for Listings and Subscriptions.
(c) No charges to Candidates
Candidate accounts, application submission, profile use, and core platform features are free of charge. If this changes, Candidates will receive at least 90 days' written notice and will never be charged retroactively for prior use.
(d) No card payments
All Employer payments are invoice-based. We do not process credit or debit card payments, nor any other automated payment instrument, through the Service.
(e) No sale of personal information
We do not sell, lease, rent, or otherwise commercially transfer your personal information to third parties. See the Privacy Policy.
5. Your account
Most features require a Talent Fiji account. You may register using a verified email address or an approved third-party single sign-on provider.
You must provide truthful, current, and complete information when you register, and you must keep your account information up to date. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. If you suspect unauthorised use, contact [email protected] immediately.
We may suspend or terminate accounts that contain false information, that are used to impersonate any person or organisation, or that we determine are operated in violation of these Terms.
6. Candidate accounts — specific terms
By creating a Candidate account you agree:
- (a) Information in your profile, including your CV, skills, experience, and references, is truthful and not materially misleading.
- (b) You own the rights to, or have permission to share, any document or content you upload.
- (c) You grant Talent Fiji a non-exclusive, royalty-free, worldwide licence to host, store, display, format, transmit, and adapt your profile, applications, and Content for the purpose of operating, securing, and improving the Service.
- (d) Your profile visibility is governed by your privacy settings; you can change or restrict visibility at any time.
- (e) You will not use the Service to harass, defraud, or impersonate any person, to obtain personal information about any person under false pretences, or to apply for Listings in bad faith.
- (f) You will not use automated tools — including scrapers, bots, headless browsers, or autonomous AI agents — to submit applications, harvest data, or interact with the Service, except via APIs we expressly authorise.
7. Employer accounts — specific terms
By creating an Employer account you agree:
- (a) You are authorised to act on behalf of the organisation you represent.
- (b) Every Listing is for a legitimate, lawful, and currently-open employment opportunity. You will not post fraudulent Listings, "data harvesting" Listings, multi-level marketing schemes, pyramid schemes, or commercial structures that are not bona fide employment.
- (c) You will not discriminate against any Candidate, in the content of a Listing or in any decision arising from the Service, on any ground prohibited by Fiji's Employment Relations Act 2007 — including race, colour, gender, sexual orientation, age, physical or mental disability, HIV/AIDS status, marital status, family responsibilities, pregnancy, religion, political opinion, national extraction, or social origin — or on any other ground protected under the employment law applicable to the role's location (including the Australian Fair Work Act 2009 and Anti-Discrimination Acts, the New Zealand Human Rights Act 1993 and Employment Relations Act 2000, or other applicable law).
- (d) You will not require any Candidate to pay any fee — including for application, training, equipment, "registration", or any other reason — as a condition of applying for, being considered for, securing, or performing any role posted on the Service.
- (e) You will respect the privacy of Candidates whose profiles and applications you access. Candidate personal data may be used only for legitimate recruitment purposes related to the specific role for which the Candidate applied, unless the Candidate provides separate explicit consent.
- (f) You will respond to Candidate applications in a reasonable timeframe and, where the Service provides a status field, you will keep that status current.
- (g) You will pay invoices in accordance with Section 10.
8. Acceptable Use Policy
Your use of the Service is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. Breach of the Acceptable Use Policy is a breach of these Terms and may result in immediate suspension or termination.
9. Content and Listings
When you post a Listing, profile, message, review, or other Content to the Service, you grant Talent Fiji a non-exclusive, royalty-free, worldwide licence to host, store, display, format, transmit, distribute, and adapt that Content for the purpose of operating, securing, promoting, and improving the Service.
You retain ownership of your Content. You can request removal by emailing [email protected] or, where the Service provides a self-service removal option, using that directly.
We may remove, modify, or refuse to publish Content that we determine, in our reasonable discretion, breaches these Terms, the Acceptable Use Policy, applicable law (including the Fiji Online Safety Act 2018), or that poses a risk to other users or to the integrity of the Service. New Employers' first three Listings are subject to manual review before they are published publicly.
We will remove Content in response to lawful orders issued by the Online Safety Commission of Fiji or any other competent authority. We may also remove Content under our Acceptable Use Policy without an external order.
10. Invoice billing terms
Talent Fiji bills Employers by invoice. All prices are published in Fijian Dollars (FJD) on our pricing page and are inclusive of Value Added Tax (VAT) where applicable.
- (a) Payment method. Payment is by bank transfer to the account specified on the invoice. We do not accept credit or debit card payments.
- (b) Payment terms. Net 7 days from the invoice issue date, unless otherwise agreed in writing.
- (c) Overdue invoices. Invoices remain "issued" until paid. At 7 days past the due date status moves to "overdue". At 14 days past the due date, the related Employer account may be suspended — all active Listings paused — until the invoice is paid. We will issue at least one written reminder before suspension.
- (d) Currency. Invoices are issued in FJD by default. Alternative currencies are available only by prior written agreement.
- (e) Refunds. Listings and Subscription purchases are non-refundable once the Listing or Subscription period has begun, except where required by Fijian consumer protection law (Consumer Council of Fiji Act and related), the Australian Consumer Law (where applicable), or the New Zealand Consumer Guarantees Act 1993 (where applicable).
- (f) Subscriptions. Monthly Subscriptions renew automatically each month unless cancelled at least 7 days before the renewal date. Cancellation takes effect at the end of the current paid period; no pro-rata refunds for partial months.
- (g) Founding Cohort. Founding Cohort Employers — the first 30 Employers invited to the platform — receive up to 3 free Standard listings during a 30-day founding window and a 30% discount on year-one Subscription or Unlimited plans. Founding Cohort status is granted by Talent Fiji at our discretion; standard Subscription terms apply after the founding window.
- (h) VAT. Where VAT applies, it will be itemised on the invoice.
11. Intellectual property
The Talent Fiji platform — including its design, code, brand, wordmark, monogram, copy, photography, the Taledi cultural brand element, and the masi-inspired background pattern — is owned by Talent Fiji Pte Limited or our licensors. You may not copy, reproduce, modify, distribute, or commercially exploit any part of the Service without our prior written consent.
You retain ownership of Content you create or upload, subject to the licence in Section 9.
If you believe Content on the Service infringes your intellectual property rights, send a notice to [email protected] containing: your identity and contact details; identification of the work allegedly infringed; the URL of the allegedly infringing Content; a statement that you have a good-faith belief the use is unauthorised; a statement under penalty of applicable perjury law that the information is accurate; and your physical or electronic signature.
12. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties, conditions, and representations not expressly set out in these Terms, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant the accuracy, completeness, or quality of Listings, Candidate profiles, or other Content posted by Users. We are not responsible for the conduct of any User, online or offline, or for any employment offer made by any Employer.
To the maximum extent permitted by law, Talent Fiji's total aggregate liability arising out of or in connection with these Terms or the Service is limited to the greater of (i) FJD $500 or (ii) the total fees you have paid to us in the 12 months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profit, loss of opportunity, loss of data, or business interruption.
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded — including under the Consumer Council of Fiji Act, the Australian Consumer Law (where applicable), the New Zealand Consumer Guarantees Act 1993 (where applicable), or any non-excludable statutory guarantee.
13. Indemnity
You agree to indemnify and hold harmless Talent Fiji, its directors, officers, employees, contractors, and authorised agents against any claim, loss, damage, liability, fine, or expense (including reasonable legal fees) arising out of (i) your use of the Service, (ii) your breach of these Terms or the Acceptable Use Policy, (iii) Content you post, or (iv) your interactions with other Users — to the extent the claim is attributable to your conduct.
14. Termination
You can close your account at any time via your account settings or by emailing [email protected].
We may suspend or terminate your account if (i) you breach these Terms, the Acceptable Use Policy, or applicable law; (ii) your continued use poses a risk to other Users or the Service; (iii) we are required to do so by lawful order; or (iv) for any other reason on reasonable notice in accordance with applicable law.
If we terminate your account for cause attributable to your breach, you are not entitled to a refund. If we terminate your account for other reasons, we will provide a pro-rata refund of any prepaid Subscription fees covering the unused period.
Sections 9, 11, 12, 13, 15, and 16 survive termination.
15. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of Fiji. Subject to the next paragraph, any dispute arising out of or in connection with these Terms or the Service is subject to the exclusive jurisdiction of the courts of Fiji.
- (a) For Candidates and Employers based in New Zealand, you may also enforce any non-excludable consumer rights in the courts of New Zealand.
- (b) For Candidates and Employers based in Australia, you may also enforce any non-excludable consumer rights in the courts of Australia.
- (c) Informal resolution first. Before commencing any formal proceedings, you agree to attempt to resolve any dispute by contacting [email protected] and allowing 30 days for resolution.
- (d) Regulatory orders. Nothing in this Section limits the jurisdiction of the Online Safety Commission of Fiji or any other competent regulator to issue and enforce orders against Content on the Service.
16. Changes to these Terms
We may amend these Terms from time to time. We will notify you of material amendments by email and by publishing the updated Terms on this page at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
If you do not accept the amendments, you may close your account at no charge before the effective date.
17. General
- (a) Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force.
- (b) No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- (c) Entire agreement. These Terms, together with the Privacy Policy, Cookies Policy, Acceptable Use Policy, and Accessibility Statement, constitute the entire agreement between you and us regarding the Service.
- (d) Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to a successor entity in the event of merger, acquisition, restructure, or sale of substantially all our assets.
- (e) No agency. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and Talent Fiji.
- (f) Force majeure. Neither party is liable for failure or delay caused by events beyond reasonable control, including natural disaster, civil unrest, government action, network outage, or pandemic.
